1. Scope of Application

For all orders via our online shop the following terms and conditions apply. Our online shop is directed exclusively to consumers, not to traders.

Consumer means an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession. Trader means a person acting for purposes relating to that person’s trade, business, craft or profession, whether acting personally or through another person acting in the trader’s name or on the trader’s behalf.

2. Contractual Partner, Formation of Contract

The purchase contract is concluded with Unwastify GbR (Marte Fougner Wang & Mladen Lacic).

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. You may place our products in your basket without obligation and amend your entries at any time prior to submitting a binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in your basket. Once you have sent your order you will immediately receive a confirmation via e-mail.

3. Contract Language, Saving of the Contract Text

Languages available for signing the contract: German, English

We save the text of the contract and forward the order data and our terms & conditions to you by e-mail. The text of the contract cannot be accessed via the internet for security reasons.

4. Delivery Conditions

In addition to the indicated product prices there may be shipping costs. You will find more detailed information about possible shipping costs in the offers

We only dispatch goods en route; pick up by the customer is not possible.

5. Payment

The following payment methods are available in our online shop:

Pre-Payment

If you choose the prepayment payment method, you will be provided with our bank details in a separate e-mail. We must receive payment in advance before your order can be processed and the goods can be dispatched.

Credit Card

With the submission of the order, you are sending us your credit card details at the same time. After your identification as the legal cardholder, directly after the order, we will ask your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and charged to your card.

PayPal

During the ordering process you will be forwarded to PayPal’s online website. To pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your access data and confirm the payment instructions to us. After submitting your order in the shop we instruct PayPal to initiate the payment transaction.Directly afterwards, the payment transaction is carried out automatically by PayPal. You will receive additional information during the ordering process.

Sofort by klarna

After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account that is activated for online banking, identify yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

6. Damage During Delivery

If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

7. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.

The following applies to used goods: if the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects occurring within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.

The above limitations and shortening of the period do not apply to claims for damages caused by us, our legal representatives or vicarious agents

• in case of injury to life, body or health

• in the event of intentional or grossly negligent breach of duty or fraudulent intent

• in the event of breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)

• within the framework of a guarantee promise, if agreed or

• as far as the scope of application of the product liability law is opened.

8. Liability

For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation

• in case of injury to life, body or health

• in case of intentional or grossly negligent breach of duty

• in the case of guarantee promises, if agreed, or

• as far as the scope of application of the product liability law is opened.

In the event of a breach of material contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely, (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.

Otherwise claims for damages are excluded.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) which can be accessed here. We are neither obliged nor prepared to participate in dispute resolution proceedings before a consumer dispute resolution agency.
